To the maximum extent permitted by law, WabaForYou shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your use or inability to use the services; (ii) unauthorized access to or alteration of your transmissions or data; or (iii) any conduct or content of any third party on the services.
You agree to indemnify, defend, and hold harmless WabaForYou and Divisha Business Solutions Pvt Ltd, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the services, your violation of these Terms, or your infringement of third-party rights.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where WabaForYou is based, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within that jurisdiction.
